First reading amendments to the Family Code ban remuneration on substitute motherhood

Substitute mothers could only be paid the necessary expenses for the temporary leave of absence, the amount of the medical expenses needed for the good health during pregnancy, for the delivery and the after delivery period. The new provisions define the meaning of substitute motherhood – a contractual relationship between a married couple and another woman, willing to carry out their fetus conceived through assisted reproduction methods, where genetic material of the couple is used. The amendments stipulate the mandatory provisions of the “substitute motherhood” contract, which enters into force after a court’s approval. Such contract could only benefit married couples in which the wife suffers from infertility, at least one of the spouses is a Bulgarian citizen and the other leaves permanently in Bulgaria, and the couple has previously registered into a special register for substitute motherhood services.
